How to Order. We intend to offer you unsurpassed service by shipping your order the same day it is placed. Our deadline for same day shipments is 1:30 PM for all U.S. time zones (except 11:30 AM for Hawaii and 12:30 PM for Alaska).
To protect our products, we generally do not ship out regrigerated items on Friday. If a Saturday delivery is required, please let us know.
Our business hours are 6 AM to 5 PM PST, Monday through Friday.

We want to fill your order promptly and accurately. To avoid confusion, we request that you state information in the following order:
- Your Account Number
- Your "Ship To" address
- Catalog Number
- Description of Item
- Quantity of Item
Order all culture media by the package, not by the unit. For example, order ten packages of Blood Agar, Cat. no. A10, when 100 plates are needed.
Please review order confirmations carefully and immediately report any discrepancies.
Pricing and Payment. Pricing is subject to change without notice. Each shipment is followed by a corresponding invoice that will be mailed to the invoice address on record. Please pay from the invoice, because no statement will be sent.
Please ask us about volume discounts and special bid prices.
After credit approval, our terms are "net 30 days" from the invoice date. We reserve the right to change credit terms at any time. Any amount due after 30 days is subject to a late charge of 1.5% per month and subsequent orders may be held. In the event any action is recessary to collect amounts due, Hardy Diagnostics is entitled to recover all costs and expenses, including reasonable attorneys' fees. | Shipping & Returns
Shipping and Delivery. All shipping terms are “F.O.B. Destination, freight prepaid and add,” unless other arrangements have been made. This term means that freight will be paid by Hardy Diagnostics, but the cost of freight will be added to the invoice; also, Hardy Diagnostics will file any damage claims. Shipping terms for freight collect and third party orders will be “F.O.B. Origin, freight collect”: meaning that the Hardy customer will be invoiced directly by the carrier and any damage claims must be filed by the Hardy customer.
Shipping and Handling Charges. Shipping charges and delivery dates quoted at the time the order is placed are estimates only. Any shipping, special handling, or hazardous material fees will be added to the invoice. The current shipping fees are as follows:
- Minimum shipping charge: $12.70.
- Minimum order: none (except for certain low sales volume products, in which case you will be notified at time of order).
- Routine handling charge: none.
- Third party and freight collect fee: $8.00.
- Microbiologics shipping fee (hazardous): $38.00 ($25.00 if for third party or freight collect).
- COD fee (collect on delivery): $11.00 (no fee for third party or freight collect).
- Hazardous material fee: $25.00 (up to four of the same item).
- Vendor drop ship fee: $8.00.
- Saturday delivery fee: $15.00 per box (no fee for third party or freight collect).
- International handling fee: $25.00 per order.
- Restocking fee: 25%.
- Non-sufficient funds fee (returned checks): $25.00.
Errors, Shortages, or Damaged Shipments. For damaged shipments, please note damage on the freight bill and retain the documentation, contents, and packaging for inspection until a damage claim is filed with the carrier. Receipt of shipments without written notice of damage on the freight bill is often considered by the carrier to be evidence that the shipment was delivered in good condition. For “F.O.B. Destination, freight prepaid and add” shipments, Hardy Diagnostics will file the damage claim with the carrier. In contrast, for “F.O.B. Origin, freight collect” shipments, the damage claim is filed with the carrier directly by the Hardy customer, since ownership is transferred to the customer at the time of shipment (not delivery). Damaged shipments, as well as shipment errors or shortages, must be reported to a Hardy Diagnostics Representative within five (5) business days of the date of delivery to the Hardy customer in order to receive credit or replacement.
Outdates. For most culture media products received with less than 28 days dating and unable to be used within that time, Hardy Diagnostics will issue credit or replacement for the unused portion. Please notify a Hardy Diagnostics Representative at the time of expiration.
Returns. Notification of a problem must be communicated to a Hardy Diagnostics Representative within five (5) business days of the date of delivery to the Hardy customer to be considered for credit or replacement. Most refrigerated or frozen items will be deemed non-returnable. To be considered for credit, returns must be packed securely, display a Returned Goods Authorization (RGA) number (issued by a Hardy Diagnostics Representative), and be received by Hardy Diagnostics in original condition no more than fourteen (14) business days for non-refrigerated items, and no more than seven (7) business days for refrigerated items, after the date of delivery to the Hardy customer. Refrigerated and frozen returns must be sent back by overnight delivery. Returns are subject to a 25% restocking fee.

| Quality Control & Technical Information

CLIA and CLSI Requirements. Currently, Clinical Laboratory Improvement Amendments (CLIA) regulations make an exception for laboratories using commercially prepared culture media that is quality controlled by the manufacturer in accordance with the CLSI M22-A3 standard. Laboratories need not perform quality control checks for sterility, growth, selectivity and/or inhibition and biochemical responses provided that: the laboratory has documentation on the media label or brochure that the quality control practices used by the manufacturer conform to the CLSI M22-A3 specifications. According to CLIA regulations, the laboratory must also document the receipt and condition of each batch of media, and notify the media manufacturer of certain visual deficiencies. Refer to 42 C.F.R. Sec. 493.1 et seq. (2004); see Quality Control for Commercially Prepared Microbiological Culture Media; Approved Standard—Third Edition, NCCLS document M22-A3, NCCLS, Wayne, PA, 2004, published by the Clinical and Laboratory Standards Institute (CLSI), formerly NCCLS.
QC Voucher. To assist the laboratory in meeting its Quality Control needs, Hardy Diagnostics provides such documentation on its media label and on a QC Voucher accompanying every shipment of media certifying that its quality control practices conform to the CLSI M22-A3 specifications. Additionally, the laboratory is relieved of having to keep separate records by virtue of Hardy’s QC Voucher indicating the lot number and expiration date of each batch of media. The QC Voucher also provides a place to sign and date, verifying that the shipment has been inspected for visual deficiencies and found to be acceptable (or not acceptable, in which case a Hardy Diagnostics Representative must be notified).
HUGO™ Technical Information. Pursuant to the CLSI M22-A3 standard, the end-user laboratory should retain the most current version of the technical information provided by the manufacturer, indicating the manufacturer’s basic specifications and controls for each medium type. Technical information indicating Hardy Diagnostics’ basic specifications and controls for each medium type (e.g., Instructions for Use (IFU), formerly “product insert”) is published in our technical manual in the form of a software program titled HUGO™ (Hardy User Group Observer), which is available at no charge to all Hardy customers, and online at our website www.HardyDiagnostics.com in the catalog section.
Certificates of Analysis and MSDS. Certificates of Analysis are available online at www.HardyDiagnostics.com for media batches certifying that representative samples from a particular lot have been analyzed and found to meet the specifications published in our technical manual in the form of HUGO™ and online at our website. Material Safety Data Sheets (MSDS) can also be accessed through the Hardy online catalog.

| Warranty
What Is Covered. Hardy Diagnostics warrants that products manufactured by Hardy Diagnostics (“Products”) and purchased by Hardy customers meet the specifications published in our technical manual in the form of a software program titled HUGO™ (Hardy User Group Observer), which is available at no charge to all Hardy customers, and online at our website www.HardyDiagnostics.com. We make no other warranty of any kind, express or implied, including merchantability and fitness for a particular purpose.
How Long Coverage Lasts. This warranty lasts for six (6) months from the date of delivery of Products to Hardy customers, except for Products that have an expiration date, in which case the warranty lasts until the expiration date.
What Is Not Covered. This warranty does not cover problems that occur for any reason after the Products are delivered to Hardy customers, including, but not limited to, force majeure (e.g., act of nature, act of war), and shall not apply to: (i) Products that have not been used, handled, or stored in accordance with the specifications; (ii) Products modified in any way without prior approval of Hardy Diagnostics; (iii) Products subjected to abuse, negligence, or accident; (iv) products not manufactured by Hardy Diagnostics, in which case any warranties shall in all respects be limited to those extended to Hardy Diagnostics by other manufacturers; and (v) Products that are used in the presence of products other than those set forth in the specifications. Also, consequential and incidental damages are not recoverable under this warranty.
What Hardy Diagnostics Will Do. Hardy Diagnostics will credit the purchase price and transportation charges paid by Hardy customers for the quantity of the Products involved, or, at the election of this company, will replace such quantity and pay the transportation charges for the replacement. The remedy of credit or replacement is the exclusive and sole remedy of Hardy Diagnostics.
The liability of Hardy Diagnostics under this warranty, whether in contract, tort, or otherwise, shall not, except as expressly provided herein, exceed the price of the products and transportation charges on which such liability is based.
How to Get Service. In order to be eligible for service under this warranty, the problem must be reported to Hardy Diagnostics in writing within five (5) business days after it becomes apparent while the warranty lasts, provided an opportunity is afforded for examination of the purchase by Hardy Diagnostics Representatives.
Governing Law. This warranty shall be governed by the laws of the State of Wyoming, which is the state of incorporation of Hardy Diagnostics.
